Fayetteville Child Custody Lawyer

Separation and divorce are not the ingredients for losing your child. North Carolina courts are not that callous. In fact, they hold the best interests of your child at the top of their priority list. At our firm, Heather D. Miller Nichols PA, we hold a very similar view.

From day one, both parents have the opportunity to be involved with their child. "Full" custody does not exist in North Carolina. Typically, one parent is designated as the primary custodial parent — the individual with whom the child lives — and the other is the secondary parent, who the child visits. Child custody comes in three forms:

  • Joint custody: This is the most common form of custody. The child lives with the primary parent, who holds most of the decision-making power, while the child then visits the secondary parent, who still has some decision-making power. Both parents have the right to be involved with the lives of the children.
  • Shared custody: This is less common. Both parents have equal time and decision-making abilities.
  • Sole custody: This happens least often in our area. The primary parent has all of the decision-making power, and the child visits the secondary parent on a limited basis, if appropriate.

It is certain that life will change for both you and your child, but with the help of our Fayetteville child custody attorney, we can set up a visitation schedule that gives both parents time with their child. This includes Web cam, Skype and phone visits, which are very important to military servicemen and women who are stationed elsewhere or overseas.
